Just got back from overseas and found this!
If this was a ‘Rights Managed’ image then I think the agency MUST warn buyers of previous sales in a similar industry sector.
It’s something we’ve always done as a matter of principle at http://www.naturespic.co.nz / http://www.naturespic.com. & I believe it’s vital in a quality industry people can trust in.
Otherwise, flog your images at ‘Rights Free’ rates but let customers know the risks they face. I wonder what terms it was licenced under? Regards, Rob

This situation happens often – especially with images from overseas libraries. Once my front cover pic ended up being used in an ad within the publication and we had to change it for example. I agree with Glenda that most readers would be unaware of the repetition – how many L&L readers will remember Kia Ora from almost two years ago anyway? We use photo libraries in the knowledge that the images they sell aren’t exclusive to the purchaser – the business model wouldn’t work otherwise.

Jeez, does no-one care about the kid? Did the kid get paid twice and doesn’t this cast up a human rights question – should adults be able to use their kids as models without their (rational) consent? But hey we are the nation that is delighted to smack them. So maybe scrap that, let’s smack them, then photograph them and slap their photograph on any media channel that’s willing to pay.

Wow! February 08 was 19 months ago! Let it go Paul… ACP obviously never purchased an exclusivity on that image and why would Photonewzealand be at fault? and for that matter Fairfax? Does any traveller or anyone remember the Feb 08 issue of Kia Ora? I doubt it… total mountain out of a molehill with far too much banter! (in my humble opinion) :-)

This is hilarious. Whatever happened, ‘Rob Lile’ has come across incredibly unprofessional, I almost feel embarrassed for him and his poor staff. Any company would do well to steer clear of anything he has an invested interest in.

Don’t you think that this is only relevant to the advertising and publishing industries? I don’t think anyone buying or reading the magazines will remember Kia Ora versus NZ Life & Leisure … if that was the case then the women’s weekly market would never survive; how many of those are the same every week?
