It’s the sound all magazine publishers dread: the smug tap of ACP’s Paul Dykzeul’s keyboard as he relishes the moment to rub your nose in the sand. Ouch!
Says Dykzeul: “ACP Magazines are proud to have provided the latest cover for NZ Life and Leisure, produced by their close friends at Fairfax Magazines, who have used a Photo NZ image for their latest issue September/October 09 issue.
“The same image was used on the cover of ACP’s KiaOra, the Air New Zealand in-flight magazine, in February 2008.”

I can never understand why publishers bother to deal with such a sloppy outfit (Photo NZ) when there are far superior online NZ libraries available now. PhotoNZ images always look so bland and boring. Unless of course Photo NZ heavily discount their shots which would explain a lot. The old adage “you get what you pay for” is very apt in this game.

Hello Mischievous Competitor (quite obviously Emma at Canvas and/or ‘colleagues’. Methinks you should be aware of full facts before making comment. There is no cockup at all with photonewzealand. I know your businesses VERY well and you should be careful with any comments re ‘sloppyness’, knowing your capabilities (or lack thereof) for data integrity as I do. ‘Sam’ – I think you need to take a look in the mirror re ‘nasty unprofessional comments’ … full information as to how this occurred will be disclosed in due course – I don’t hide behind anonymous handles as you try to. It would have been nice if Stop Press had checked with Fairfax and photonewzealand prior to running this and allowing others to try to make ‘petty’ mileage out of it. Emma, thanks for the comments and for your suggestion about moderation.
We’ve decided to carry on with the open forum for two reasons:
- the discussion is self managing (your comments in particular have been helpful)
- there’s nothing defamatory so far
Our overall approach is to leave the discussion as open as possible and let it self manage towards clarity. Turning comments on or off takes on editorial responsibility that we don’t necessarily want.

Some good lessons here. We use a focus group to help us select covers (thanks “cover girls”). I hope they are well read and spot if we’re following and not leading!

I don’t think anyone buying or reading the magazines will remember Kia Ora versus NZ Life & Leisure … if that was the case then the women’s weekly market would never survive; how many of those are the same every week?

This is hilarious. Whatever happened, ‘Rob Lile’ has come across incredibly unprofessional, I almost feel embarrassed for him and his poor staff. Any company would do well to steer clear of anything he has an invested interest in.

Wow! February 08 was 19 months ago! Let it go Paul… ACP obviously never purchased an exclusivity on that image and why would Photonewzealand be at fault? and for that matter Fairfax? Does any traveller or anyone remember the Feb 08 issue of Kia Ora? I doubt it… total mountain out of a molehill with far too much banter! (in my humble opinion) :-)

Jeez, does no-one care about the kid? Did the kid get paid twice and doesn’t this cast up a human rights question – should adults be able to use their kids as models without their (rational) consent? But hey we are the nation that is delighted to smack them. So maybe scrap that, let’s smack them, then photograph them and slap their photograph on any media channel that’s willing to pay.

This situation happens often – especially with images from overseas libraries. Once my front cover pic ended up being used in an ad within the publication and we had to change it for example. I agree with Glenda that most readers would be unaware of the repetition – how many L&L readers will remember Kia Ora from almost two years ago anyway? We use photo libraries in the knowledge that the images they sell aren’t exclusive to the purchaser – the business model wouldn’t work otherwise.

Just got back from overseas and found this!
If this was a ‘Rights Managed’ image then I think the agency MUST warn buyers of previous sales in a similar industry sector.
It’s something we’ve always done as a matter of principle at http://www.naturespic.co.nz / http://www.naturespic.com. & I believe it’s vital in a quality industry people can trust in.
Otherwise, flog your images at ‘Rights Free’ rates but let customers know the risks they face. I wonder what terms it was licenced under? Regards, Rob
